Big changes are coming for small business with H-1B applications, processes, and related workforce contributors - get and stay up to date with NSBA.
OCT. 28, 2025 | Last week, NSBA responded to a Department of Homeland Security (DHS) U.S. Citizenship and Immigration Services (USCIS) proposed rule that would implement a weighted selection process generally favoring the allocation of H-1B visas to higher skilled and higher paid workers, using Department of Labor (DOL) "Wage Levels" to measure skill and compensation.
In the comments, NSBA recommend against using DOL Wage Levels as the basis for reform of the H-1B lottery system. The comments explained that the Wage Level system would risk shutting out small businesses from contention in the H-1B process altogether, as small businesses are overwhelmingly reliant on so-called "lower-tier" Wage Levels.
NSBA also signed onto a comment letter led by Engine opposing proposed $100,000 H-1B visa fee, which would make it harder and more expensive for high-skilled talent to come to the U.S., ultimately hindering innovation.
